AUCTION TERMS AND CONDITIONS

Absolute Auction
All Parcels are being sold at Absolute Auction. No Limit-No Reserve- Must be sold

Auction Deposits
To be eligible to bid every bidder MUST present a Cashier’s Check
Made payable to: The Piatelli Company-Trust Account in the amount
Of: Two Thousand Five Hundred Dollars ($2,500.00) For EACH parcel.

Escrow and Title Insurance
On any parcel sold for over $25,000.00 escrow and title charges will be Split 50/50 between Buyer and Seller. On all parcels sold for less than $25,000.00, buyer to pay all escrow and Title charges. Seller to pay transfer taxes. Property Taxes to be Prorated.

Buyers Premium
As in all auctions, a Ten (10%) Percent Buyers Premium will be added to The High Bid.
Example: if a high bid is $20,000.00 the sales price will be $22,000.00

Free and Clear of all Monetary Liens
Sellers guarantee that all parcels will be Free and Clear of all Monetary Liens at the close of escrow.

As Is: Where Is
Buyer acknowledges that all parcels are being sold
“As Is - Where Is“ at Public Auction subject to:

All existing covenants,conditions, restrictions,easements,rights of way, Zoning, subdivision requirements,as well as any other restrictions of the use of the property and any other items of record, as well as any kind
of encumbrances discernable from a physical inspection of the property.

Inspection
Buyer acknowledges already having inspected the property and fully Investigated zoning and other land use restrictions, as well as availability of access and utilities or lack of same and having Read and understood
the Terms and Conditions of this auction before making a bid, or having the opportunity to bid.

United States Federal Bankruptcy Court
Buyer consents to the jurisdiction of the United States Federal Bankruptcy Court to enforce the Terms and Conditions of this sale and resolve any dispute relative thereto. All offers are “irrevocable and subject to approval of the court. If necessary to comply with the paper work of the Bankruptcy Court buyer agrees that this escrow may close anytime within 90 days.

Real Property Taxes
All Real Property Taxes will be prorated in escrow.
